Services and information requirements regulation

The Service and Information Requirement Regulation (Dienstleistungs-Informationspflichten-Verordnung – DL-InfoV) which was put into force on the 17 May 2010 serves on the basis of the delegating legislation according to sec. 6c Gewerbeordnung (Industrial Code – GewO) to implement the services directive in the European Union on services in the internal market. This regulation regulates the content, extent and type of information which a service provider needs to make available to the recipient of this service, either in general or if requested. The DL-InfoV shall also apply to legal services. As far as lawyers or law firms have an internet presence, many information requirements under the DL-InfoV are regulated already by existing legal provisions, especially sec. 5 TMG.

Information regarding Chamber and professional regulations as well as sec. 5 TMG

The legal occupation of all the professionals working in our office is “Rechtsanwalt” or “Rechtsanwältin” (i.e. “Lawyer” in the male or female form); they all are admitted to the bar in the Federal Republic of Germany and are members of the Rechtsanwaltskammer Sachsen (i.e. the bar association in Saxony – www.rak-sachsen.de) which is the responsible chamber for our lawyers (Rechtsanwaltskammer Sachsen, Glacisstraße 6, 01099 Dresden).

  • Berufsregeln der Rechtsanwälte der Europäischen Gemeinschaft (Code of Conduct of the Council of Bars and Law Societies of Europe, CCBE);
  • Gesetz über die Tätigkeit europäischer Rechtsanwälte in Deutschland (Law regulating the activity of European lawyers in Germany – EuRAG).

Extrajudicial settlement of disputes:

If disputes arise between German lawyers and their clients, such disputes can be settled out of court by applying to the regional Bar Association (Rechtsanwaltskammer) (pursuant to sec. 73 (2) no. 3 in conjunction with sec. 73 (5) BRAO), i.e. the Rechtsanwaltskammer Sachsen, or to the Dispute Resolution Office of the Attorneys in Berlin, Neue Grünstraße 17, 10179 Berlin (www.schlichtungsstelle-der-rechtsanwaltschaft.de) (Schlichtungsstelle der Rechtsanwaltschaft) at the German Federal Bar Association (Bundesrechtsanwaltskammer) (sec. 191f BRAO) (by e-mail: schlichtungsstelle(at)brak.de).This Office is responsible for pecuniary dispute resolution between consumers and their lawyers, although we are not legally required to take part in this dispute resolution.
